Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and 36 Seconds, LLC, a Delaware limited liability company doing business as LACE’D Tape (“Company”), with principal operations in New York, New York. By accessing or using this website, you agree to these Terms in full. If you do not agree, discontinue use immediately.

1. INTELLECTUAL PROPERTY — PATENTS, TRADEMARKS & COPYRIGHT

All intellectual property on this Site belongs exclusively to 36 Seconds, Inc. and its founder. This includes:

Patents: The Dynamic Function Fashion Tape and Methodology and related innovations are owned by Julia Ann Burns and protected by U.S. Patent Nos. 11,779,061 and 12,349,744, with U.S. Patent Application No. 19/241,036 pending. All patent rights are exclusively licensed to 36 Seconds, Inc. Unauthorized manufacture, use, sale, offer for sale, or importation of any infringing product or method constitutes patent infringement under 35 U.S.C. §§ 271 and 281–285. The Company actively enforces these patents and will seek all available remedies, including injunctive relief, compensatory damages, lost profits, and attorneys’ fees.
Trademarks: “LACE’D Tape,” “36 Seconds,” “Fit and Lift Studio Experience,” and all associated logos and branding are trademarks of 36 Seconds, Inc. Unauthorized use is prohibited.
Copyright: All Site content — text, images, design, video, and copy — is © 36 Seconds, Inc. You may not reproduce, distribute, or create derivative works without prior written permission.
Trade Secrets: Design methods, manufacturing processes, and business strategies accessible through this Site are protected trade secrets under the Defend Trade Secrets Act (18 U.S.C. § 1836).
No Implied License: Nothing on this Site grants any license to any patent, trademark, copyright, or trade secret by implication, estoppel, or otherwise.

2. PROHIBITED USES

You may not: reproduce or resell any Site content; reverse engineer any described product or method; use Site content to train AI models; scrape or harvest data from the Site; or access the Site for competitive intelligence purposes.

3. NO LICENSING WITHOUT WRITTEN AGREEMENT

No license to manufacture, sell, or exploit any of the Company’s patented inventions, trademarks, or copyrighted works is granted by these Terms or by any use of this Site. Any licensing arrangement requires a separate signed written agreement. Verbal representations are not binding on the Company.

4. FIT AND LIFT STUDIO EXPERIENCE

Services are subject to these Terms and any separate service agreement. Participation in any consultation or fitting session does not grant you any rights in the Company’s underlying methods, techniques, or intellectual property.

5. CONFIDENTIALITY

Any non-public information you receive regarding the Company’s products, inventions, or business is strictly confidential. You may not disclose it to any third party without the Company’s prior written consent. This obligation survives termination of your use of the Site.

6. DISCLAIMERS AND LIMITATION OF LIABILITY

THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, 36 SECONDS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE. TOTAL LIABILITY SHALL NOT EXCEED 00 OR THE AMOUNT PAID BY YOU TO THE COMPANY IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER.

7. INDEMNIFICATION

You agree to indemnify and hold harmless 36 Seconds and its members, managers, employees, and agents from any claims, damages, or expenses (including attorneys’ fees) arising from your violation of these Terms or infringement of the Company’s intellectual property rights.

8. GOVERNING LAW

36 Seconds is a Delaware limited liability company with principal operations in New York. These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. All disputes shall be resolved exclusively in the state or federal courts of New York County, New York.

9. MODIFICATIONS

We may update these Terms at any time. Continued use of the Site following any update constitutes acceptance of the revised Terms.
